Welcome to YOOKLA Sleep. These Terms of Use (“Terms”) govern your use of the YOOKLA Sleep mobile application (the “App”), provided by YOOKLA / Timurbek Sattarov (“we”, “us”, or “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree to these Terms, please do not use the App.

1. About the App

YOOKLA Sleep is a mobile application designed to help users relax and sleep with calming sounds, white noise, sleep timer features, favorites, and optional premium features.

The App is provided for personal use only.

2. License to Use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions and App Store rules.

The App is licensed to you, not sold.

3. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms.

You agree not to copy, modify, reverse engineer, decompile, or attempt to extract the source code of the App, except where permitted by applicable law; use the App for any unlawful, harmful, abusive, or fraudulent purpose; interfere with or disrupt the operation of the App; attempt to bypass premium access controls, subscription checks, or other technical limitations; or use the App in a way that may damage, disable, or impair the App or related services.

4. Personal Recordings and User Content

The App may allow you to create and store personal recordings on your device.

You are responsible for any recordings or other content you create using the App.

You agree not to create, store, or use content that is unlawful, harmful, abusive, infringing, or violates the rights of others.

Personal recordings are stored locally on your device. We do not access, review, upload, or control your recordings.

5. Premium Features, Purchases, and Subscriptions

YOOKLA Sleep may offer optional premium features through in-app purchases or subscriptions.

Premium features may include access to additional sounds, custom sleep timer options, gentle fade-out, personal recordings, or other features described in the App.

Purchases and subscriptions are processed by Apple through the App Store. We do not process payments directly and do not store your payment card information.

Subscription availability, pricing, billing, renewal, cancellation, and refunds are managed through Apple and your Apple ID settings, unless otherwise required by applicable law.

6. No Medical Advice

YOOKLA Sleep is intended for relaxation, sleep support, and general wellbeing.

The App is not a medical device and does not provide medical advice, diagnosis, treatment, or professional healthcare services.

If you have sleep problems, medical concerns, or health-related questions, please consult a qualified healthcare professional.

7. Intellectual Property

The App, including its design, interface, graphics, sounds, text, features, software, and other content, is owned by us or licensed to us and is protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, sell, lease, or create derivative works based on the App or its content without our prior written permission, except as allowed by these Terms or applicable law.

8. App Store and Apple

If you download the App from the Apple App Store, you acknowledge and agree that these Terms are between you and us, not Apple; Apple is not responsible for the App or its content; Apple has no obligation to provide maintenance or support services for the App; Apple is not responsible for addressing claims relating to the App or your use of the App; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as third-party beneficiaries.

9. Maintenance and Support

We are responsible for providing support for the App as described in these Terms or as required by applicable law.

Apple has no obligation to provide support or maintenance services for the App.

10. Disclaimers

The App is provided on an “as is” and “as available” basis.

To the maximum extent permitted by applicable law, we make no warranties or representations regarding the App, including that the App will always be available, uninterrupted, secure, or error-free; the sounds or features will meet your specific needs or expectations; or any issues in the App will be corrected immediately.

Some jurisdictions do not allow certain warranty exclusions, so some of the above limitations may not apply to you.

11. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the App.

This includes, without limitation, loss of data, loss of device functionality, loss of profits, or other intangible losses.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws.

12. Changes to the App

We may update, modify, suspend, or discontinue parts of the App at any time.

We may also add, remove, or change features, including free and premium features.

If changes are material, we may provide notice through the App, on our website, or by updating these Terms.

We may update these Terms from time to time.

Any changes will be posted on this page with an updated effective date. Your continued use of the App after the updated Terms become effective means that you accept the updated Terms.
